De Palestinian Human Rights Monitoring Group (PHRMG) komt - eindelijk - met een duidelijk statement tegen zelfmoordaanslagen. Het paper neemt voor Palestijnse begrippen in heldere taal stelling tegen zelfmoordaanslagen, en dan niet alleen omdat ze de Palestijnse zaak zouden schaden, maar omdat het doden van burgers tegen het internationale recht indruist. Dit is zeer goed nieuws, al kan men zich natuurlijk afvragen waarom men er nu pas mee komt, nadat er zo'n 1.000 Israëli's door zelfmoordaanslagen zijn omgekomen.
Met een cynische blik zou je kunnen beweren dat nu zij hun effectiviteit hebben verloren, nu het immers nauwelijks nog lukt om aanslagen in Israël uit te voeren vanwege onder andere de afscheidingsbarrière en de checkpoints, en ze nog slechts schade toebrengen aan de Palestijnse zaak, het in het Palestijnse belang is ze ook officieel te veroordelen. Zo heeft Hamas enorm veel krediet gekregen voor een zogenaamd staakt-het-vuren waaraan men zich niet altijd hield, en tijdens welke men op grote schaal wapens smokkelde. In de tijd hiervoor pleegde men nauwelijks meer aanslagen, maar nu kon men dit presenteren als het gevolg van een eigen keuze, en niet van effectieve Israëlische maatregelen.
Minder cynisch gezegd zou deze veroordeling het begin van een eerlijke discussie onder de Palestijnen kunnen zijn over wel en niet geoorloofde vormen van 'verzet' en de manier waarop de islam wordt misbruikt om mensen voor de meest walgelijke daden te rekruteren.
Het zou goed zijn, en de grond onder bovengenoemd cynisme uithalen, als met de veroordeling van zelfmoordaanslagen ook de dagelijks afgevuurde kassamraketten worden veroordeeld. Als, kortom, alle geweld tegen burgers wordt veroordeeld.
This paper outlines the background, the need, and the recommendations that the PHRMG has made to bring an end to the merciless practice of suicide attacks (SAs). The goal of this project is to draw attention to its practice, its harms, the reasons for its popularity, and to promote dialogue of this issue amongst the Palestinian community in order to bring an end to such an egregious means.
The PHRMG strongly condemns SAs, and it is the position of this paper to argue against the needless killing of civilians on both sides of the political divide. This paper explores the motivations behind undertaking such actions, the legal context in which these crimes are committed, the responsibilities of the Palestinian legal system in upholding HR, and the role that humanitarian organizations can play in eliminating public support for this callous practice.

The practice of SAs is a violation of international law, and the Palestinian government must be held responsible for upholding the principles of HR.
According to international humanitarian law (IHL), the guidelines are salient - the killing of civilians is illegal. However, the situation gains complexity when trying to decide what actually constitutes a "civilian". The presence of Israel as a military state further obfuscates this theoretical simplicity.
Het is mij niet geheel duidelijk wat er complex is aan het verschil tussen een burger en een soldaat. Een soldaat draagt een uniform en een wapen. Volgens het oorlogsrecht is een soldaat die geen dienst doet en op weekendverlof is, een burger. Het is totaal irrelevant of burgers op een bepaald moment in hun leven soldaat zijn geweest of nog worden, of dat nu lang of kort geleden is en of zij nog een keer per jaar reservedienst doen of niet. De suggestie dat het onderscheid in Israël moeilijk te maken is (in tegenstelling tot andere landen, die minder militaristisch zouden zijn?), is onoprecht en moreel zeer verwerpelijk.
Het is bovendien een slimme propagandatruc, want het eigenlijke probleem wat dit betreft ligt aan Palestijnse kant: milities, 'verzetsstrijders', guerrilla's, militanten, strijders of terroristen: we weten vaak niet eens hoe ze te noemen. Ze dragen soms wel en soms geen uniform, strijden soms tegen militairen en dan weer tegen burgers of tegen allebei tegelijk, gebruiken huizen, moskeeën en scholen om zichzelf en/of hun wapens in te verbergen, en laten zich door burgers omringen om zich te beschermen tegen Israëlische aanvallen.
Er is dus eerder sprake van complexiteit aan Palestijnse dan aan Israëlische zijde, en de Palestijnen maken handig gebruik van het feit dat voor deze nieuwe manier van oorlog voeren nog weinig regels zijn. Terwijl Israël keer op keer wordt veroordeeld omdat het niet genoeg doet om burgerdoden te vermijden, omdat haar reactie disproportioneel zou zijn, omdat zij burgerdoelen zou aanvallen, gaan de Palestijnen vaak vrijuit omdat zij zich slechts zouden verzetten tegen een vreemde bezetter, er geen staat is die opdracht heeft gegeven tot bepaalde operaties en altijd onduidelijk is of en in hoeverre de officiële Palestijnse Autoriteit de 'strijders' heeft geholpen of hier nou eenmaal niks tegen kan doen.
Over de motieven van de plegers van zelfmoordaanslagen zegt PHRMG:
This paper conclusively eliminates numerous specious correlations and stereotypes surrounding SAers - including that of being psychologically disturbed, mentally incompetent, poverty-stricken, and driven by religious fervor. We have shown that an insightful analysis portrays the average SAer as a rational actor living in an irrational world, and thus susceptible to modification. Indeed, SAers appear to be driven by strong nationalistic zeal, systematic oppression by a population whose culture is significantly different from their own, an ensuing feeling of helplessness and despair, a devout hatred for a neighboring tangibly occupying force, and a false assurance by organizations as well as a manipulation of religious scriptures to more easily guide such individuals towards imminent self-destruction.
We have also conclusively demonstrated that Islam - and its underlying ethos - is not inherently responsible for SAs. Islam is a religion and culture that promotes peace and understanding. Unfortunately, it is the work of manipulative theologists with significant influence who often obscure the benign messages enshrined in the Qur'an.
Het is goed dat men de zelfmoordterrorist neerzet als iemand die rationeel handelt, en niet als een geesteszieke. Daarbij moet worden aangemerkt dat ook vaak ten onrechte wordt beweerd dat zelfmoordterroristen gedreven worden door armoede en ellende. Uit verschillende onderzoeken blijkt dat zij veelal tot de middenklasse behoren en een goede opleiding hebben.
Hoewel de PHRMG erkent dat naast sterke nationalistische ideeën, een gevoel van wanhoop en een wrede bezetting, ook haat voor Israël en religieuze manipulatie een rol spelen, wordt de islam als een religie van vrede neergezet. Het is jammer dat men het niet aandurft om een van de belangrijkste motivaties van zelfmoordterroristen openlijk te bespreken: het concept van de Jihad, de strijd tegen de ongelovigen die wel degelijk is ontleend aan passages in zowel de Koran als de Hadith. Hamas leiders en imams refereren hieraan en roepen de mensen op hieraan gehoor te geven. Het handvest van de Hamas is een grote oproep aan iedere Palestijn om zijn leven in dienst van de strijd voor Allah te stellen. Kinderen krijgen op Al Aqsa TV te horen dat de ongelovigen gedood moeten worden.
Men zal op de één of andere manier moeten erkennen dat je niet de Koran letterlijk kunt nemen en de islam als religie van vrede neerzetten. Men zal moeten erkennen dat er een radikale tak is in de islam die niet veel met vrede en verzoening opheeft. Sommigen halen inspiratie uit de Koran voor een leven vol naastenliefde en verzoening, anderen worden geïnspireerd tot zelfmoordaanslagen. Beiden kunnen zich beroepen op teksten uit de Koran en met name de laatsten ook uit de handelingen van de profeet. Het leven van de profeet biedt helaas heel wat inspiratie voor de strijd tegen de Joden. Na dit discussiestuk wordt het misschien tijd voor een paper over de relatie tussen moslims en Joden, waarin het wijdverbreide antisemitisme onder de Palestijnse bevolking eens onder de loep kan worden genomen.
Ondanks al mijn kritische opmerkingen is het ontzettend goed en belangrijk en ook moedig dat het PHRMG zich zo duidelijk heeft uitgesproken, de wijdverbreide steun voor zelfmoordaanslagen in de Palestijnse gemeenschap erkent, en de eigen (religieuze) leiders alsmede de media hiervoor mede verantwoordelijk houdt.
The matter of public support has also been addressed. SAs, quite simply, would naturally cease to exist if they materialized in a vacuum. Unfortunately, this is not the case. It is largely the fault of both political and religious leaders who continue to advocate its utility as well as the media's known bias and social construction that this epidemic persists. While some leaders and media journalists have altered their path on this subject - a majority still either blatantly supports the use of SAs or sends mixed messages, which simply complicates the complex. The PHRMG, therefore, calls upon both its political and religious leaders and media representatives to bring this matter into center stage and seriously educate the population on the ramifications of such a futile and egregious means.

The Palestinian Human Rights Monitoring Group condemns suicide attacks
The Palestinian Human Rights Monitoring Group's (PHRMG) mission is to end human rights (HR) violations against Palestinians, regardless of who is responsible. Given the absence and/or ineffectiveness of democratic mechanisms of accountability in Palestine, PHRMG's main strategy, since it's founding in 1996, is to hold the HR violator accountable before the Palestinian public - and the international community at large. Our methods are a simple and effective recipe of on-the-ground field research and HR education. With these activities providing a solid foundation, PHRMG also implements special projects with tangible HR impacts.

Researching the SA phenomenon is imperative as there is little accurate information available concerning the real motivations behind carrying out a SA. This is a topic that typically evokes emotional - rather than objective responses. The subject of SAs is controversial because it is difficult within the religious community to come to a consensus as to whether or not SAs are in violation of Islamic scriptures.
It is also a challenging subject when discussing this subject in the political context. There are arguments on both sides as to whether it is an effective tool in the arsenal against occupation. Many Palestinians, who in practice may disagree with SAs, rarely vocally oppose its occurrence, thereby allowing this practice to persist with impunity. Despite the myriad difficulties in conducting research of this nature, we feel that this topic cannot be ignored when evaluating the HR situation in Palestine. Therefore, an organized effort must be made to educate the public about the social, emotional, and legal ramifications of undertaking such actions.

Analyzing the causes that drive young Palestinian men and women to commit SAs is a daunting task. Notwithstanding this difficulty, this paper attempts to delineate the basic profile of SAers. Several contextual factors are discussed - including the historical background and motivational factors.
Moreover, the opinions of Palestinian and Israeli professionals will add to the overall analysis.
The purpose behind defining both the rationale and motivations behind SAs is twofold. First, to hopefully reduce the number of further attacks. It is hoped that this task may be addressed by publicly confronting such motivations and subsequently dispelling them. Second, is to prevent false labeling of SAers with specious psychological definitions that prove effective only in leading the media, the public, and government officials astray. Therefore, PHRMG asks that Palestinian professionals in particular take note of our research and become more outspoken against the practice of SAs. Indeed, the Palestinian voice is often missing or inaccurate on such sensitive matters.

The Palestinian Human Rights Monitoring Group (PHRMG) is a Palestinian, independent, non-governmental organization working to end human rights violations committed against Palestinians in the West Bank, Gaza Strip, and East Jerusalem, regardless of those responsible. The members of the PHRMG believe that the strength of democracy and civil society in Palestinian society will be determined by the Palestinian people, through their defense or neglect of human rights.
